Terms and Conditions
By using the dress hire service of Ysabellaque Limited, you hereby accept and agree to the terms and condition of this business.
Ysabellaque Limited agrees to lease the property described in the Rental Agreement to the hirer on the following terms and conditions.
The property that the hirer takes possession of, as outlined in the Rental Agreement is owned by Ysabellaque Limited.
The hirer will examine and try on the garment and by proceeding to hire, the hirer acknowledges that the garment is in immaculate condition.
Ysabellaque Limited will not be liable in any way in respect of any claim made against the hirer for any damage caused by the hirer's use of the property.
The hirer agrees that they are liable to Ysabellaque Limited for any loss of property or part of the property, damage of the property and will be required to meet the replacement cost of the property and additional cost
The hirer agrees that they will retain possession and control of the property throughout the hire.
The hirer agrees to return the property to Ysabellaque Limited in the same condition as received and on the return date and time outlined in the Rental Agreement.
Ysabellaque Limited reserves the right to charge additional hire time if the property is not returned by the specified date and time.
Ysabellaque Limited reserves the right to retain all booking fees on any cancelled bookings or when a customer does not proceed with hiring a garment.
The hirer acknowledges that when there is a default in arranged payment between the hirer and Ysabellaque Limited, Ysabellaque Limited will refer the hirer’s personal information and charges to a debt collection agency to recover the cost.
Rental Agreement
Definition
For these conditions, the terms “you” and “your” refer to all HIRER and (“we’ “us” and “our”) refers to Ysabellaque Limited
(NZBN 9429049156676).
Introduction
This Rental Agreement is a legally binding agreement between you as the customer and us, Ysabellaque Limited. This agreement was established by us for the dress hire service that we provide.
If you in any way do not agree to our Rental Agreement and Terms and Conditions, we reserve the right to decline your business and refuse our services to you.
Bond
A security bond of $200.00NZD is required when using our hire service.
Your bond will be fully refunded on the return of the garment at the agreed date and time and in good condition which will be determined by the Ysabellaque team.
Ysabellaque will use the bond in the first instance as cost recovery when the following applies:
□ Late fee (this does not apply if the garment is lost or damaged)
□ Repair for minor damages
□ Missing garment bag - valued at $30.00 per garment bag.
□ Missing gangers - valued at $10..00 per hanger.
The security bond will not be used as a cost recovery for damaged or lost garments.
□ If the Ysabellaque team determines that a garment is lost/damaged, the security bond will automatically be non-refundable.
Cleaning
Professional cleaning is included in the hire price and you agree that no attempts will be made to clean or alter the garment.
If there are marks/stains visible after it has been dry cleaned, the garment is then considered to be damaged. This will be determined by us.
Return and Late Fee Policy
Please ensure that the garment is returned to us by the agreed date and time described in the hire form.
If the garment is not returned on the agreed date and time, late fees will be charged daily for each day passing the agreed date and time.
□ The late fee is 100% of the hire price for the gown hired which will be added each day proceeding with the agreed return date and time.
□ You are liable for any subsequent rentals that had to be cancelled due to the late return of the garment.
Lost, Damaged and Repairs
If the property is lost whilst in your possession:
□ you are liable to pay for the full retail price of the dress at the time of hire.
□ you are liable for the cost of any subsequent rentals that had to be cancelled due to the lost garment.
We will determine whether damage(s) are repairable once we have examined the gown at our store. If the damage requires minor repairs:
□ you are liable to pay for the full cost of any repairs.
The garment is considered damaged when we determine that minor damages cannot be repaired. This means we no longer can hire the garment out again and as such:
□ you are liable to pay for the full retail price of the dress at the time of hire.
□ you are liable for the cost of any subsequent rentals that had to be cancelled due to the garment being damaged.
Liability
Where you are required to pay only for minor repairs or late fee, this will be taken out of your bond in the first instance.
If the cost for repairs exceeds the value of the bond, you are liable to pay the excess cost
Where you are required to pay for the retail price of the garment – due to the loss or damage of the garment;
you will be charged the difference in the retail and hire price of the garment.
Example:
The hire price for your garment is three-hundred and fifty dollars ($350.00) and the retail price of the garment is valued at seven-hundred and fifty dollars ($750.00) if you are liable to pay the full retail price, you are required to pay the difference. In this case, you are required to pay
four-hundred dollars ($400.00).
As outlined under the Bond section, the security bond is automatically non-refundable when you are liable for loss and damage to the garment.
Cancellations and refunds
Whilst we acknowledge that unforeseeable circumstances can occur, our dress hire service is non-refundable for both the booking fee and dress hire price.
In the event where you’re no longer needing the garment due to unforeseeable circumstances, we can instead grant you with a ‘store credit’ for the same value to hire the same/another dress at a later date pending availability.
□ In this instance, you will need to notify the Ysabellaque team 24 hours before the agreed pick up date and time.
□ If we are notified less than 24 hours of the agreed pick up date and time, it is at the discretion of the Ysabellaque team whether a store credit is warranted.
The booking fee will be deducted from the overall hire price when you proceed with our hiring service.
The booking fee is non-refundable if you cancel your booking, not attend the appointment or where you do not proceed with our hiring service.
Rescheduling a confirmed booking at your request is at the discretion of the Ysabellaque team.
Privacy
All personal information provided to us will be kept confidential in line with the Privacy Act 2020.
Debt Collectors
Where you are liable to pay Ysabellaque Limited any cost stipulated throughout this Rental Agreement, payment arrangement will be discussed agreed to by you and the Ysbellaque team.
Failure to adhere to the payment arrangement established by you and Ysabellaque Limited will result in your charges will be referred to a Debt Collection Agency which will affect your credit score.
As such, you agree that if any charges are passed on to a Debt collection agency you will be liable for their fees and recovery costs.
DECLARATION
